These Terms of Service (the "Terms") govern your access to and use of Floggy (the "Service"), a platform for hosting personal blogs and portfolios on subdomains and custom domains, along with related features such as newsletters, notes, tasks, calendar booking, analytics, and a content API. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Accounts
You must provide accurate information when you create an account and keep it up to date. You are responsible for everything that happens under your account and for keeping your login credentials secure. You must be at least 13 years old, or the minimum age of digital consent in your country, to use the Service. Notify us promptly if you believe your account has been accessed without your permission.
2. Acceptable Use
You agree not to use the Service to:
- break any applicable law or infringe anyone else’s rights;
- publish content that is unlawful, defamatory, or that you have no right to share;
- distribute malware, phishing pages, spam, or other harmful material;
- attempt to disrupt, overload, or gain unauthorized access to the Service or its infrastructure;
- scrape or abuse the Service or its API beyond reasonable, documented limits;
- impersonate others or misrepresent your affiliation with any person or entity.
We may suspend or remove content, or suspend accounts, that we reasonably believe violate these Terms.
3. Your Content
You retain ownership of the content you create and publish through the Service ("Your Content"). You grant us a limited, non-exclusive license to host, store, reproduce, and display Your Content solely to operate and provide the Service, including delivering your blog to visitors, sending newsletters you compose, and generating previews and feeds. This license ends when you delete Your Content or close your account, except for content already delivered to others (such as sent newsletters) or retained as required by law or for backups.
You are solely responsible for Your Content and for having the rights necessary to publish it.
4. Subscriptions and Billing
The Service offers a Free plan and a Pro plan. Pro is billed at $12 per month and includes a one-week free trial. Plan features and pricing may change; we will give reasonable notice of material changes.
Payments are processed by our merchant of record, Polar (Polar Software Inc.). Polar acts as the reseller of the Service and handles checkout, billing, taxes, and payment data. Your purchase is also subject to Polar’s terms. We do not store your full payment card details.
Unless stated otherwise, subscriptions renew automatically at the end of each billing period until cancelled. If you do not cancel before your free trial ends, your paid subscription begins and the applicable fee is charged.
5. Cancellation and Refunds
You can cancel your Pro subscription at any time from your account settings or through Polar. When you cancel, you keep Pro access until the end of the current billing period, after which your account returns to the Free plan. Except where required by law or expressly stated, payments are non-refundable. Refund requests are handled by Polar in line with its refund policy.
6. Custom Domains
If you connect a custom domain, you are responsible for owning that domain and for configuring DNS correctly. You are responsible for any fees charged by your domain registrar. We are not responsible for downtime caused by misconfiguration or by third parties outside our control.
7. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Where reasonable and lawful, we will give you notice. On termination, your right to use the Service ends and we may delete Your Content after a reasonable period.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content will be preserved without loss.
9. Limitation of Liability
To the maximum extent permitted by law, Floggy and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the revised Terms.
